ATTENTION! New penalties have been approved for employers

Article 48 of the Labour Code, titled "Documents Submitted by an Employee When Entering into an Employment Contract," regulates the documents that an employee must provide to the employer upon recruitment.
Following the amendments dated 19 May 2026, Article 48.5-3 was revised to prohibit the employment of a person in the relevant profession or position without the health certificate required under Article 48.5 and the narcological examination (medical examination) report required under Article 48.5-2.
The required documents are:
Health certificate – required for professions and positions listed in the Resolution No. 1 of the Cabinet of Ministers of the Republic of Azerbaijan dated 3 January 2000.
Narcological examination (medical examination) report – required for professions and positions where restrictions apply to individuals with narcological disorders, issued by a state narcological medical institution in accordance with Resolution No. 145 dated 12 September 2002.
By the Law of the President of the Republic of Azerbaijan dated 7 July 2026, Articles 192.13 and 192.14 were added to the Code of Administrative Offences, establishing employers' liability regarding these documents.
Under Article 192.13, if an employer concludes or continues an employment contract with a person who is medically recognized as having a narcological disorder for a profession or position where such individuals are restricted from working, the responsible official is subject to a 3,000 AZN fine.
Under Article 192.14, if an employee is hired without the required health certificate or narcological examination report in cases prescribed by the Labour Code, the responsible official is subject to a 1,000 AZN administrative fine.
