Control measures are taken in cases of refusal to use POS-terminals
Despite the repeated warnings and awareness-raising activities of the State Tax Service under the Ministry of Economy, it is observed that non-cash payments are made through card-to-card transfer operations, not POS-terminals, in retail trade and catering facilities.
In order to prevent the mentioned cases, the State Tax Service has strengthened control measures in this direction. Thus, during the control measures held in the facilities belonging to taxpayers engaged in catering and retail trade activities in Baku city, a number of facts related to the organization of card-to-card transfers of non-cash payments were recorded. As a result of the measures, it was determined that in 43 facilities, card numbers were displayed in visible places, and in a number of facilities, customers were offered to systematically make card-to-card transfers.
Despite the initial warnings of the tax authorities, taking into account that these cases continued in those facilities, protocols were drawn up and decisions were made to apply financial sanctions to business entities.
At the same time, as cases of refusal to use POS-terminals were observed, monitoring and tax control measures are being continued in the territory of Baku city.
The State Tax Service once again informs that the receipt of non-cash funds should be carried out only through the POS-terminal, and at this time citizens should be presented with the receipt of the POS-terminal as well as the check of the cash register. According to the Law "On Protection of Consumer Rights", installation of POS-terminals, and according to the Law "On Electronic Commerce", creation of the possibility for consumers to make electronic payments belong to the direct duties of taxpayers.
Entrepreneurs must ensure the use of POS-terminals during non-cash payments in order not to be subject to financial sanctions.
