Despite numerous appeals, cases of abusing the trust of individual citizens in order to obtain illegal income and establishing various legal entities in their names are still encountered. During the investigations conducted by the State Tax Service under the Ministry of Economy, it was determined that in most cases, citizens are deceived in various ways and various legal entities are established in their names by obtaining a power of attorney or using their electronic signatures, illegal transactions are carried out and, as a result, these legal entities incur large amounts of tax debt. In such cases, due to the debt of legal entities to the state budget, the right to leave the country of the formally appointed “director” is temporarily restricted by a court decision, and when a significant amount of tax debt is incurred to the state budget, criminal proceedings are initiated against these legal entities.
In a number of cases, citizens do not know that they are taxpayers and bear personal responsibility, or they are deliberately misinformed by persons who are the actual leaders of illegal entrepreneurial activity.
The State Tax Service under the Ministry of Economy calls on citizens to be careful when delegating their powers of entrepreneurial activity to third parties and not to create conditions for other persons to use their electronic signature. According to the legislation, an electronic signature belongs only to its owner. The owner of an electronic signature is responsible for its protection and should not allow it to be used by another person. Citizens are responsible for the creation of legal entities established in their name with an electronic signature on the basis of the power of attorney they have issued and for their legal consequences.
A citizen who provides his electronic signature to another person in exchange for certain promises may face tax debt, seizure of property, and bankruptcy. Taking this into account, citizens should not believe various promises in relations with other persons, should not sign documents whose content they do not understand, and should not trust their electronic signature to other persons.
