The Cabinet of Ministers of the Republic of Azerbaijan has approved the "State Civil Servant Rotation Rules" and the "Rules for Compensations and One-Time Payments to State Civil Servants Appointed Outside Their Administrative Territorial Unit Under Rotation" by its Decision No. 36 dated February 20, 2025. Expert Nusrat Khalilov explains these rules:
According to the rules, when a civil servant is rotated to another position, the classification of the administrative position held, the specialty, the result of the evaluation of their service activities, the length of service, as well as their age, family, and health status are taken into account. Civil servants who have served less than 5 years in the relevant position are not rotated. It should be noted that rotation refers to the transfer of a civil servant holding an administrative position to another position by the decision of the head of the government agency they serve.
Organization of Rotation
The term of service for positions subject to rotation is set at 5 years. Based on the substantiated recommendation of the commission, the head of the government agency may extend this period up to two times, each time for no more than one year. Changes related to this rotation are made in the civil servant's employment contract.
Rotation is carried out in September of the relevant year. If rotation due to service necessity occurs in other months of the year, the civil servant must be officially informed at least 6 months in advance about the position and the time of the rotation. A civil servant may be rotated based on their own initiative and with the consent of the head of the government agency where they serve.
The following individuals may be rotated based on their consent:
- Women who are pregnant or have children under the age of three, as well as men who are raising children under the age of three alone;
- Individuals who have a disabled child or a family member with disabilities due to 81-100% functional impairment;
- Individuals who have less than two years left until the retirement age in the state civil service;
- Individuals for whom the location of the relevant position could negatively affect their health (based on a medical certificate);
- Individuals who have been rotated to rotation positions at least three times (for a total of no less than 15 years).
Rotation is temporarily postponed during the following periods:
- The period when the activity of the person rotated is directly managed or the financial and economic activities of the organization they supervise are being audited (checked, inspected);
- The period when a service inspection (investigation) or criminal case investigation is being conducted regarding the rotated person;
- The period when the rotated person is on vacation, on a business trip, or temporarily unable to work (based on a medical certificate).
In these cases, rotation must be carried out within one month after the above-mentioned circumstances are resolved.
Rotation is carried out either by changing or not changing the civil servant's administrative territorial unit of residence. If the civil servant is rotated to an organization located more than 50 kilometers away from their administrative territorial unit, the rotation involves changing the administrative territorial unit of residence.
Social Security of Rotated Civil Servants and Their Family Members
The state guarantees the social and legal protection of rotated civil servants and their families and ensures a decent standard of living for them. According to Article 30.5 of the "State Civil Service Law," a civil servant temporarily transferred to another location has the right to bring their family with them. They are provided with a service apartment equipped with household items in accordance with the living standards set for them, and their previous residence is maintained. The family members of the civil servant are assisted in finding employment or educational institutions, with places being provided in pre-school institutions, and if necessary, they are provided with paid medical services at the expense of the sending authority. Other issues related to temporary transfers are regulated by the Labor Code of the Republic of Azerbaijan.
In addition to the above-mentioned benefits, rotated civil servants are provided with the following:
- One-time payments to civil servants appointed to a position outside their administrative territorial unit under rotation;
- Monthly cash compensation to civil servants appointed to a position outside their administrative territorial unit under rotation;
- Support for employment opportunities for family members who have changed their administrative territorial unit and lost their jobs as a result of the rotation;
- Placement of the children of the rotated civil servant in educational institutions in the area where the civil servant is serving.
Measures to ensure the employment of family members who have changed their administrative territorial unit and lost their jobs (based on the submission of supporting documents) are taken in accordance with the "Employment Law." If the family members of the rotated civil servant were engaged in work in organizations funded by the state budget before changing their administrative territorial unit, they can be provided with work in the respective district (city) departments (organizations) of these organizations, taking into account the availability of vacant positions.
According to the rules, a family member of the rotated civil servant is defined as:
- The spouse, parents, underage children (including adopted children), dependent underage siblings, as well as the parents of the spouse (husband).
Monthly Compensations
Based on the "Rules for Compensations and One-Time Payments to State Civil Servants Appointed Outside Their Administrative Territorial Unit Under Rotation," approved by the Cabinet of Ministers of the Republic of Azerbaijan on February 20, 2025, the following payments are made to such persons:
- A monthly cash compensation of 250 (two hundred fifty) manat is paid to civil servants appointed to positions outside their administrative territorial unit under rotation.
- For each family member living with the rotated civil servant, an amount equal to 50% of the compensation set above is paid.
Example 1: A civil servant whose workplace is located in Baku and is registered in the city of Khirdalan has a salary of 1,500 manat. He is required to continue his work in Ganja city under the rotation rules. The civil servant has family members: his father, mother, wife, two children, and a 20-year-old sister under his guardianship. How much compensation will he receive?
In this example, in addition to his salary, the civil servant will be paid a monthly cash compensation of 250 manat. The following compensation will be paid for his family members:
As seen, the rotated individual has 6 family members. However, compensation will be calculated for 5 of them. This is because, according to the "General Provisions" section of the rules, the term “under the guardianship of underage sisters or brothers” is used. According to Article 28 of the Civil Code, the legal age of adulthood is considered to be 18 years. Since the individual’s sister is 20 years old, she is considered an adult and is thus not included as a family member. Therefore, compensation will be calculated for 5 family members, and the total amount to be paid will be 875 manat:
- For the civil servant: 250 manat
- For family members: (250 x 50%) x 5 people = 625 manat
- Total: 250 + 625 = 875 manat
If there is any change in the family composition during the civil servant's rotation, the rotated individual must notify the personnel department of the government agency or the responsible person performing the personnel functions in agencies without a personnel unit, within 10 days.
If a civil servant is rotated to an organization located more than 50 kilometers away from their administrative territorial unit but does not change their place of residence, they will only receive a monthly cash compensation of 250 manat.
Example 2: A civil servant is registered and living in the city of Khirdalan. He will continue his work in the village of Alat under the rotation rules. In this case, the employee will not change their place of residence. The distance between Khirdalan city and Alat village is 80 kilometers, so they will receive only 250 manat in monthly cash compensation.
According to Article 21-1 of the Labor Code, a 1.5 multiplier is applied to the compensations for civil servants and their family members working in the liberated territories of the Republic of Azerbaijan.
Example 3: A civil servant whose workplace is in Baku and who is registered in Khirdalan city, with a salary of 1,500 manat, will continue working in Shusha city under the rotation rules. He has three family members: his wife and two children. How much compensation will he receive?
Based on Article 21-1 of the Labor Code, specialists working in the liberated territories of the Republic of Azerbaijan are entitled to the discounts and privileges outlined in the Labor Code and other laws of the Republic of Azerbaijan, provided the following conditions are met:
- The employer with whom the specialist has signed an employment contract is registered for tax purposes in the liberated territories;
- The work location of the specialist under the employment contract is in the liberated territories;
- The specialists have settled in the liberated territories (registered in their place of residence or location).
According to the rules, if these criteria are met, the compensations for civil servants and their family members working in the liberated territories will be multiplied by 1.5. In this case, the following compensation will be calculated and paid:
- For the civil servant: 250 x 1.5 = 375 manat
- For family members: (250 x 50%) x 3 = 375 manat
- 375 x 1.5 multiplier = 562.5 manat
- Total: 375 + 562.5 = 937.5 manat
One-Time Payment
Civil servants rotated to positions outside their administrative territorial unit are entitled to a one-time payment equal to three times the minimum monthly wage set for the country.
Example 4: For the civil servants in the examples above, in addition to the monthly compensation, they will receive a one-time payment equal to three times the minimum monthly wage to cover relocation costs and other necessary expenses for settling in the new administrative territorial unit:
- 400 manat x 3 = 1,200 manat.
According to the rule, the one-time payment does not replace the allowance provided to specialists working in the liberated territories for supporting initial living conditions. A one-time allowance of 600 manat is provided to specialists working in the liberated territories to support their initial living conditions. This allowance is provided for the period from January 1, 2023, to January 1, 2028, according to the Law of the Republic of Azerbaijan on Amendments to the Law on Social Benefits, dated December 9, 2022, No. 683-VIQD.
According to the rule, the compensation and one-time payment are provided at the expense of the state budget. The individuals who were appointed to the positions and sectors where rotation has been applied before the rule came into effect are not subject to this rule. The amount of the monthly compensation (250 manat) provided under the 2.1 section of the rule will be reviewed every three years.
