From Which Date Does the Income Tax Exemption for War Veterans Apply?

Tax relief for income earned from employment by individuals who have been granted war veteran status is determined by law. The application of these tax benefits, the required documentation, and the date from which the relief takes effect are governed by the relevant provisions of the Tax Code.
According to Article 102.2.7 of the Tax Code, the monthly taxable income from employment of individuals who have been granted war veteran status in accordance with the procedure established by law is reduced by AZN 400. This relief is taken into account when calculating personal income tax on salary and reduces the amount of income subject to taxation by the specified amount.
To benefit from this relief, the relevant document confirming war veteran status must be submitted to the individual's primary place of employment. The list of required documents is established by the “List of Documents Required to Determine Individuals’ Eligibility for Tax Benefits When Calculating Tax Withheld from Salaries,” approved by Resolution No. 4 of the Cabinet of Ministers of the Republic of Azerbaijan dated January 4, 2001.
Under Article 102.8 of the Tax Code, an individual's entitlement to the relevant tax benefits takes effect upon submission of the required supporting documents, and the relief is granted exclusively at the individual's primary place of employment. However, if an individual already holds a status that entitles them to tax relief but submits the supporting documents after the employment contract has entered into legal force, the tax relief is calculated from the date on which that employment contract entered into force.
The date on which war veteran status becomes effective is an important factor in determining when the tax relief applies. Submitting the relevant document to the primary place of employment at a later date does not, in itself, change the date on which the entitlement to the relief arose. Subject to the effective date of the status and other applicable conditions, the relief may be applied from that date.
Individuals seeking recalculation of income tax withheld from their salaries in previous periods and a refund of any excess amounts withheld are advised to contact their employer’s accounting department. The process should involve reviewing the document confirming war veteran status, the date on which the status became effective, and previous income tax calculations relating to salary payments. Whether a recalculation can be made for a specific period and any excess tax refunded must be assessed in accordance with the relevant documentation and applicable legal requirements.
It should be noted that although income tax relief is provided for employment income earned by individuals with war veteran status, the legislation does not provide an exemption from mandatory state social insurance contributions, unemployment insurance contributions, or compulsory health insurance contributions on this basis. Therefore, the AZN 400 relief applies solely to the calculation of personal income tax and does not automatically extend to other insurance contributions.
