In the second part of Article 69 of the Labor Code, we have written that the circumstances for dismissal have been determined. For example, an employee retires due to age or disability, enters a relevant educational institution to continue his education, moves to a new place of residence, signs an employment contract with another employer, is subjected to sexual harassment, etc. cases can be shown. I wonder if the employee has an obligation to provide the employer with a document confirming the existence of the condition stated in the application?
Example. The employee asks to be released from work on February 18, based on the fact that he moved to a new place of residence on February 11. Can the employer request that any reference confirming the employee's move to a new place of residence be attached to the application?
In our opinion, although it is not an absolute requirement to attach documents for the cases mentioned in the application, the employer has the right to ask for those documents. When an employee files an application, the employer can request a document confirming the correctness of the reason or, if there is a trade union committee, an investigation. It is also possible that the employer believes in the correctness of the situation stated in the application and does not require any supporting documents.
