In what cases does the EMAS subsystem impose restrictions on the employment of a person?

The EMA subsystem applies some restrictions regarding the person to be employed. The restrictions applied can be divided into two groups:
Restrictions on the age of the person to be employed
According to the fourth part of Article 46 of the Labor Code, an employment contract may be concluded with individuals who have reached the age of fifteen. For this reason, the EMA imposes restrictions on the employment of persons under the age of 15. When an employer wishes to conclude an employment contract with a person under the age of 15, he is presented with a restriction notice with the following content: “According to labor legislation, an employment contract cannot be concluded with persons under the age of 15”
Restrictions on ID card data
In the EMA subsystem, citizens' ID card data is processed by the relevant departments of the Ministry of Internal Affairs. If the information on the document is deactivated when the employer enters the ID card data of the person he wants to employ, it is impossible to proceed to the next stage of concluding an employment contract. Reasons for deactivation of an ID card include the expiration date of the document or a change in the serial number of the entered document.
