Liabilities Related to Labor Contracts and Tax Sanctions
According to the Labor Code of the Republic of Azerbaijan, if an employer engages individuals to perform any work (services) before the labor contract becomes legally binding, thereby facilitating the concealment (reduction) of their income, the employer, as well as individuals engaged in activities such as hosts, musicians, dancers, ashiq performers, clowns, and other similar occupations, as well as individuals working in the photo, audio-video, and food service industries (waiters), must not be involved in any work without obtaining a receipt for "simplified tax, compulsory state social insurance, and compulsory health insurance payments" prior to starting their activities. For each such individual, if such a violation occurs for the first time during the calendar year, a financial penalty of 2000 AZN will be applied; for the second violation, the penalty will be 4000 AZN; and for three or more violations, the penalty will be 6000 AZN.
According to Article 192.3 of the Administrative Offenses Code of the Republic of Azerbaijan, if an employee is paid below the minimum wage set by the relevant executive authority, the responsible officials will be fined an amount ranging from 1000 to 1500 AZN.
