According to Article 122.1 of the Labour Code, employees who are in an employment relationship and are simultaneously pursuing doctoral studies to obtain an academic degree may be granted paid creative leave to complete their dissertation, and authors may receive such leave to write textbooks or teaching materials.
According to Article 138 of the Labour Code, all types of leave are formalized by the employer’s order (instruction, decision) based on the employee’s written request. The order must specify the employee’s name and surname, position (profession), the type and duration of the leave, the corresponding work year, the start and end dates of the leave, and the date the employee must resume work. As per Article 140.5, the order must be issued at least 5 days prior to the leave, and the employee must receive vacation pay no later than 3 days before the leave begins.
Based on Article 122, creative leave and its duration are defined as follows:
Up to two calendar months of paid leave for completing a PhD dissertation, and up to three months for completing a Doctor of Science dissertation. The employee uses this leave based on a certificate issued in accordance with a decision of the relevant academic council.
Employees studying in doctoral programs (including applicants preparing for admission) are granted 30 calendar days of paid creative leave each academic year.
Employees writing textbooks or teaching materials may be granted up to 3 months of paid creative leave based on a decision of the relevant executive authority and a supporting certificate.
According to Article 122.5, the academic council or executive authority must coordinate the duration and use of creative leave with the employer in advance.
During creative leave, the employee’s salary is calculated based on their established monthly wage.
Example 1: An employee is studying at the Azerbaijan Medical University as a doctoral student. He is entitled to 30 calendar days of paid creative leave each academic year. His monthly salary is 1,800 AZN. If he takes leave in June:
1,800 ÷ 30 = 60 AZN;
60 × 30 = 1,800 AZN.
Example 2: An employee writing a textbook is granted 3 months of paid creative leave. His salary is 1,800 AZN. Calculation:
1,800 × 3 = 5,400 AZN.
