War veterans with disabilities and families of martyrs are exempt from the state fee for the registration of real estate

Within the framework of consistent social reforms implemented in Azerbaijan under the leadership of the President of the Republic of Azerbaijan, Ilham Aliyev, important decisions are being adopted to improve the welfare and strengthen the social protection of vulnerable social groups. In this context, the Law of the Republic of Azerbaijan “On Amendments to the Laws of the Republic of Azerbaijan ‘On State Fees’ and ‘On the State Register of Real Estate’”, adopted by the President on 30 December 2025, is of particular importance as a continuation of these reforms.
According to the amendments made to the laws, persons whose disability has been established in connection with the defense of the territorial integrity, independence, and constitutional order of the Republic of Azerbaijan, the events of January 20, 1990, as well as the performance of military service duties at the Chernobyl Nuclear Power Plant, as well as persons granted the status of families of martyrs, are exempt from state fees for the following services and legal actions related to the registration of real estate:
- issuance of an extract on the state registration of ownership rights to real estate (including rights acquired through inheritance);
- issuance of technical documents for real estate (passport and layout plan);
- issuance of an extract related to the state registration of rights to the portion remaining with the former right holder as a result of division, encumbrances (mortgage, lease, use, leasing, servitude, etc.), as well as the encumbrance and alienation of lease and use rights;
- making a security entry related to the shares to which components (residential and non-residential units) of an unfinished building located on a land plot are attached, cancellation of the state registration of destroyed real estate and the rights thereto, and provision of information from the state register;
- additional state registration of a mortgage, state registration of a notice on foreclosure of the mortgaged property, release of real estate from encumbrances (mortgage, lease, use, leasing, servitude, etc.), issuance of duplicate technical documents for real estate (passport and layout plan);
- installation of boundary markers (pylons) during surveying works for the registration of ownership and other real rights to land plots — for each turning point;
- issuance of a certificate from the state register on restrictions (encumbrances) on rights to real estate.
