DECISION regarding the funds transferred to the Ministry of Finance’s treasury account

According to the second sentence of Article 4.3-3 of the "State Duty Law" of the Republic of Azerbaijan, the "Regulation on the Use of Funds Transferred to the Treasury Account of the Ministry of Finance of the Republic of Azerbaijan for Strengthening the Social Protection and Improving the Material Security of Its Employees" has been approved.
The Regulation on the E-duty Information System has been approved. The relevant decision was signed by Prime Minister Ali Asadov.
According to the document, this Regulation defines the procedure for the use of service fees transferred to the Ministry of Finance’s treasury account (hereinafter referred to as "off-budget funds") for the purpose of strengthening the social protection and improving the material security of the employees of the Ministry of Finance of the Republic of Azerbaijan (hereinafter referred to as "the Ministry") and its employees (hereinafter referred to as "employees").
Off-budget funds are considered the property of the state, under the disposal of the Ministry, and their disposer cannot be changed.
Off-budget funds are formed from the service fees collected based on the "e-notification" prepared for each legal action subject to state duty, as per Article 4.3-3 of the "State Duty Law" of the Republic of Azerbaijan, and according to the payment of state duties specified in Article 20-3 of the same law.
To use the off-budget funds for their intended purpose, a special treasury account for the Ministry is opened at the State Treasury Agency under the Ministry.
The accumulation and use of off-budget funds are carried out in accordance with the income and expenditure budget. The income and expenditure budget is prepared and approved in accordance with the "Regulation on Off-Budget Funds of State-Funded Institutions and Organizations of the Republic of Azerbaijan" approved by the Decision of the Cabinet of Ministers of the Republic of Azerbaijan dated November 17, 2017, No. 502 (hereinafter referred to as "the Regulation").
The distribution of off-budget funds among the Ministry’s Apparatus and the entities within its structure is formalized by the relevant order of the Ministry.
Off-budget funds are used in the following areas to strengthen the social protection and improve the material security of the employees:
- Collective and individual reward of employees;
- Additional payments to employees’ monthly salary;
- Provision of material assistance to employees.
The collective reward of employees is carried out in the following cases:
- Timely and quality completion of tasks;
- Timely completion of important state tasks, as well as other important tasks related to the Ministry's main areas of activity;
- In connection with public holidays defined by the Labor Code of the Republic of Azerbaijan and other significant events.
The individual reward of employees is carried out in the following cases:
- Timely and professional completion of the duties specified in the job description, providing suggestions for optimization, showing initiative, and implementing new forms and methods at work;
- Timely and quality completion of assignments given by the management;
- Distinction in preparing drafts of normative legal acts.
Employees may also be individually (once) rewarded for the performance of particularly important tasks and complex works, as well as for their deserving work on holidays and other significant days.
Funds may also be spent on purchasing valuable gifts for employees for individual reward purposes.
The amount of additional payment to the monthly salary of employees shall not exceed two (2) times their monthly salary.
The payment of the additional monthly salary is made once a month, by the 20th of the following month, and for the month of December, by the 25th of the month (if December 25th is a non-working day, the next working day).
During periods of annual leave, paid creative and educational leave, as well as official business trips, the employee’s working days during the reporting month are considered, and the additional payment to the monthly salary is made. However, this additional payment is not considered when calculating the average salary for the period of leave (business trip).
The additional monthly salary is not calculated for the following days:
- When the employee temporarily loses their working ability, as well as during maternity and childbirth leave;
- When the employee is on partially paid social leave or unpaid leave.
The collective and individual reward of employees, additional payments to their monthly salary, and the provision of material assistance to employees are formalized by the Ministry's order.
The accounting of off-budget funds is carried out in accordance with the requirements of the "Accounting Law" of the Republic of Azerbaijan.
Reports on the use of off-budget funds are prepared and submitted in accordance with the Regulation.
According to this Regulation, income tax, mandatory state social insurance contributions, unemployment insurance contributions, and mandatory health insurance contributions are deducted from the funds paid to employees, in accordance with the Tax Code of the Republic of Azerbaijan, and the laws of the Republic of Azerbaijan on "Social Insurance," "Unemployment Insurance," and "Health Insurance."
Other matters related to the use of off-budget funds are carried out in accordance with the Regulation.
In case of non-use of off-budget funds for their intended purpose, officials are held accountable in accordance with the Criminal Code and the Administrative Offenses Code of the Republic of Azerbaijan.
