As previously reported, a special section has been created in the ƏMAS subsystem to obtain information about persons with disabilities in the form of a report. In the “Statistical Data” subsection of the “ƏMAS” section within the ƏMAS subsystem, general statistical information on the number of employees with disabilities is provided in the “Number by Disability Groups” subcategory, similar to the sections on age groups and education levels.
In this section, the employer has access to information about the number of employees who have been classified as disabled due to impaired bodily functions in the range of 31–60% (formerly Group III), 61–80% (formerly Group II), and 81–100% (formerly Group I). However, detailed information about the composition of the number of persons with disabilities (i.e., specific employees) was not previously displayed in the “Number by Disability Groups” subsection of the ƏMAS subsystem.
The latest update made by the state body in the EMAS subsystem can be considered a change that benefits employers.
Employers must access the “Employee Disability Information” subsection under the “EMAS” section in the EMAS subsystem.
Once inside this subsection, employers will be able to obtain certain information about employees with disabilities (disability groups and causes of disability).
By searching based on the percentage of impairment in bodily functions, the employer can also group information separately about employees who have been classified with 31–60%, 61–80%, and 81–100% functional impairment.
It should be noted that there are certain requirements related to persons with disabilities in the Labor Code.
For example, according to Article 91 of the Labor Code, the working hours of employees with 61–100% impairment must not exceed 36 hours per week.
As per Article 98 of the Labor Code, employees with disabilities can only be engaged in night work with their written consent and based on the opinion of the relevant authority designated by the executive authority.
Article 119 of the Labor Code also states that employees with disabilities, regardless of the percentage, cause, or duration of impairment, must be granted at least 42 calendar days of annual leave.
Employers must ensure compliance with the minimum requirements defined in the Labor Code for persons with disabilities, using the “Employee Disability Information” section of the EMAS subsystem.
