Calculation of Educational Leave Pay and Recent Amendments

Educational leave pay is calculated based on the employee's average salary for the last two calendar months preceding the leave. The total earnings for those two months are divided by the number of working days, and the resulting daily average wage is multiplied by the number of calendar days of educational leave.
1. Duration of Educational Leave
The duration and payment rules of educational leave are regulated by Article 124 of the Labour Code of the Republic of Azerbaijan. This leave is granted only to employees studying through part-time or blended learning programs and is issued based on an official certificate from the educational institution.
Higher education institutions: 30 calendar days per academic year for first and second-year students; 40 calendar days for students in higher years. Vocational and specialized secondary schools: 20 calendar days for first and second-year students; 30 calendar days for students in higher years. State examinations: up to 30 calendar days. Thesis defense: 30 calendar days for higher education institutions; 20 calendar days for specialized secondary schools.
2. Calculation Method
Educational leave pay is calculated in accordance with Article 177 of the Labour Code. Formula: (Total salary for the last 2 months ÷ Number of working days during those 2 months) × Number of calendar days of educational leave Example: Total salary for the last 2 months: 850 AZN
Total working days: 42 Average daily wage: 850 ÷ 42 = 20.23 AZN Educational leave pay for 30 days: 20.23 × 30 = 606.90 AZN
3. Recent Legislative Changes
According to recent amendments to the Labour Code, an employee on paid educational leave retains their average salary. However, if the employee becomes ill during the educational leave period, no additional temporary disability benefit (sick leave payment) is granted, since educational leave pay is already being provided.
